Intellectual Property Court in Russia Overturned Almost One Third of Disputed Rulings of Rospatent, Same Number of FAS in 2021

According to an expert at the "Advokatskaya Gazeta" media outlet, in 2021, Russia’s Intellectual Property Court satisfied almost one third of submitted appeals on rulings involving Rospatent and the Federal Antimonopoly Service of Russia (FAS), showing the court’s independent position.

A second expert noted two trends: a general increase in the demand of business entities for justice for intellectual property rights and judicial protection and a decrease in the quality of appeals to the court of cassation, as the disputes were satisfied less. A third expert tied the growth of disputes with the increase of business activity in Russia, which began during the steady decline of the pandemic.

As previously reported, the Judicial Department of the Russian Supreme Court published the summary statistics on the activities of federal arbitration courts for 2021, which included, among other things, a report on the work of the Court of Intellectual Property.
